I. General information
1. The administrator of personal data of the website www.energixpolska.com (hereinafter: "Website") is Energix Polska sp. z o.o. based in Warsaw (00-347), ul. Wybrzeże Kościuszkowskie 43b, entered into the register of entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw. Warsaw in Warsaw, 12th Commercial Division of the National Court Register, under KRS number: 0000637006, NIP: 7010614517, REGON: 365395493, share capital: PLN 5,000.00. (hereinafter referred to as "Energix" or "Administrator").
2. The Administrator can be contacted via the IOD e-mail address , contact forms available on the Website or in writing to the address of the Administrator's office indicated above.
3. In connection with the operation of the Website, the Administrator collects and processes personal data of users, i.e. people using the functionalities of the Website (hereinafter: "User" or "Users"), described in this Privacy Policy.
4. The purpose of this Privacy Policy is to explain the principles on which Users' personal data are processed and to discuss the basic rights related to the processing of personal data by the Administrator. The privacy policy also contains information on the use of cookies or similar technologies in connection with the use of the Website, including information on the Administrator's ability to use analytical tools.

II. Purposes and grounds for processing Users' personal data
1. The Administrator processes Users' personal data and information collected using cookies to the extent necessary to enable the use of the Website or its individual functionalities. The administrator processes personal data for the following purposes:
a. providing services electronically, i.e. making the Website available to Users, including enabling them to read the published content and use the offered functionalities - the legal basis for processing is the necessity of processing to perform the contract (Article 6(1)(b) of the GDPR1)

Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation; GDPR).
b. handling inquiries sent by the User to the Administrator using contact forms included on the Website - the legal basis for processing is the legitimate interest of the Administrator (Article 6(1)(f) of the GDPR), and in the scope of additional contact details provided by the User in the contact forms - the basis the legal basis for processing is the User's consent (Article 6(1)(a) of the GDPR),
c. in the event of positive verification of the application via the contact forms included on the Website - taking actions at the User's request aimed at contacting the User,
d. conducting statistical analyzes and research - the legal basis for processing is the legitimate interest of the Administrator (Article 6(1)(f) of the GDPR) consisting in improving the quality of the services provided and the functionalities provided,
e. ensuring IT security - the legal basis for processing is the legitimate interest of the Administrator (Article 6(1)(f) of the GDPR) consisting in ensuring the safety of users using the Website,
f. pursuing and defending claims - the legal basis for processing is the legitimate interest of the Administrator (Article 6(1)(f) of the GDPR), consisting in defending its economic interests.

​2. The Administrator allows Users to contact its representatives by sending an inquiry in the "Contact us" form. Initiating contact with representatives involves the processing of personal data in order to handle the User's case. In this case, the legal basis for processing is the legitimate interest of the Administrator (Article 6(1)(f) of the GDPR), consisting in handling a telephone request and responding to the received inquiry.
3. Users' personal data processed by the Administrator may include:
a. data indicated in the contact forms available on the Website, including primarily name and surname, e-mail address and optionally telephone number,
b. identification data and contact details additionally indicated by the User, including data necessary for communication with the Administrator and its representatives,
c. other identifying data, such as the User's IP address and data from cookies used on the Website.


III. Personal data processing period
1. The period for which the Administrator processes personal data depends on the purpose for which the data is processed. Typically, the Administrator will process the User's personal data for the period of providing access to the Website and the functionalities contained therein.
2. If the basis for processing is the consent expressed by the User, the data will be processed until it is withdrawn.
3. If the Administrator processes data on the basis of a legitimate interest, the processing period lasts until the User effectively raises an objection. The personal data processing period may be extended by the limitation periods for claims if the processing of personal data is necessary for the Administrator to pursue claims or defend against such claims.


IV. Data sources
1. The Administrator generally processes personal data obtained directly from the User (e.g. data provided in the submitted form).


V. Data recipients
1. Personal data may be disclosed to other persons (entities) in the following circumstances:
a. entities providing the Administrator with services necessary to ensure the functionality of the Website, and in the case of concluding a lease agreement with the User - also necessary to conclude and perform such an agreement, including entities providing IT, telecommunications, tax, accounting and financial, advisory and auditing services, inspection, legal, or work on power equipment,
b. authorized to receive them under applicable law, including energy law, but not limited to - public authorities, i.e. courts, law enforcement agencies, regulatory bodies, attorneys or other parties.

 

VI. User Rights
1. In connection with the processing of personal data, the User has the right to:
a. withdraw consent at any time if the legal basis for data processing is consent (withdrawal of consent will not affect the lawfulness of processing carried out before its withdrawal);
b. access to the data and receiving a copy thereof;
c. rectification or supplementation of data;
d. request the deletion of personal data in cases provided for by law;
e. request to limit the processing of personal data;
f. object to data processing based on the legitimate interest of the Administrator - for reasons related to the User's particular situation;
g. not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning them or otherwise significantly affects them, unless this decision is necessary for the performance of the contract, is permitted by law or has been expressly consented to in advance agreement.
2. The User also has the right to lodge a complaint with the supervisory authority responsible for the protection of personal data in the Member State of the User's habitual residence, place of work or place of the alleged infringement. In Poland, this is the President of the Personal Data Protection Office.

VII. Cookies used on the Website
1. The Administrator uses cookies on the Website.
2. Cookies are small text files that are saved on the User's end device (e.g. laptop, tablet, smartphone) when visiting the Website. They may be used by the Administrator - in this case, they are installed directly by the Website, as well as by the Administrator's partners (e.g. Google) - in this case, the cookies come from a website other than the one visited by the User.
3. Cookies store information that is created in cooperation with the User's end device. Cookies used on the Website are primarily used to ensure the proper operation of the Website. If the User gives separate consent to the installation of other cookies, they will also be used for analytical and marketing purposes and to adjust website settings. Below, the Administrator presents detailed information about the cookies used and the possibility of managing their settings via the Website.

4. The Administrator uses cookies of the following categories on the website: necessary, marketing, functional and analytical.

Detailed information about cookies used within a given category (including information about the name and purpose of using a given cookie and its expiration period) can be obtained by the User by accessing the cookie settings available in the cookie banner displayed at the bottom of the Website after entering page. The user should click on the "settings" button available in this banner, and then select and expand the cookie category that interests him.
6. The Administrator uses technical cookies to provide the User with content and functionalities available via the Website, including ensuring the correct operation of the Website. The legal basis for the processing of the User's personal data is the necessity to perform the contract for the use of the Website (Article 6(1)(b) of the GDPR). Technical cookies may be installed via the Website by the Administrator and trusted partners.
7. Analytical cookies are used by the Administrator to understand how the User uses the Website, including where the User's traffic comes from and what content is of interest. The use of these files allows you to analyze statistics, e.g. regarding visits to the Website, in order to improve its quality and implement new functionalities. The use of these files requires the User's prior consent. The User may consent to the use of analytical cookies using the cookie banner available on the Website, and may also withdraw consent at any time in the same way. Analytical cookies may be used by both the Administrator and his trusted partners. The legal basis for the processing of users' personal data is the legitimate interest of the Administrator (Article 6(1)(f) of the GDPR), consisting in improving the Website based on analyzes of its Users' activity, in connection with the consent expressed by the User.

8. Marketing cookies are used to display advertisements tailored to the User's preferences. Collecting information about the user through these files is intended to display advertisements to that person, personalize them, measure effectiveness and conduct marketing campaigns, including on external websites or social networking sites. The legal basis for the processing of personal data is:
the legitimate interest of the Administrator (Article 6(1)(f) of the GDPR), consisting in providing information promoting the Administrator's services and preparing content dedicated to Users, in connection with the consent expressed by the User.

9. Functional cookies are used by the Administrator to remember settings that adapt the Website to the User's choices (e.g. in terms of the selected language), including personalization of the functionalities used by the User. The use of these files requires the User's prior consent. The User may consent to the use of functional cookies using the cookie banner available on the Website, and may also withdraw consent at any time in the same way. Functional cookies may be used by both the Administrator and his trusted partners. The legal basis for the processing of the User's personal data is the legitimate interest of the Administrator (Article 6(1)(f) of the GDPR), consisting in improving the quality of the access service provided to the Website, in connection with the consent expressed by the User.
10. The use of analytical, marketing and functional cookies requires separate consents from the User. The User's consent is not required only in the case of cookies necessary to provide access to the Website. Without the use of necessary cookies, it is not possible for the Administrator to provide access to the Website.

11. The User may express separate consent to the use of analytical, marketing and functional cookies using the cookie banner displayed after entering the Website.
12. The User can manage the granted consents, including withdrawing the granted consents at any time by changing cookie settings by calling up the cookie banner.

VIII. Voluntary processing
1. Providing personal data by the User is voluntary, however, failure to provide the data by the User will result in the inability to use the Website, including its functionalities, such as using contact forms or sending inquiries to the Administrator or its representatives.

IX. Transfer of data to third countries
1. In connection with the Data Administrator's use of codes/scripts, including: in the form of Google Analytics, Users' personal data will be transferred to a third country, i.e. to the USA, based on the decision of the European Commission stating that the USA ensures an adequate level of personal data protection and in connection with the inclusion of the supplier of the above-mentioned tool on the list of certified entities, in relation to to which this decision applies (Data Privacy Framework).


X. Final provisions
1. This Privacy Policy is constantly verified and updated, if necessary.
2. The website is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to provide our services to you. Your data may be stored through Wix.com's data warehouse, databases and general Wix.com applications. Wix stores your data on secure servers behind a firewall.
3. The current version of the Policy is valid from August 2024.
